1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and SANK BUSINESS INC, a Delaware C Corporation ("Company," "we," "our," or "us"), governing your access to and use of the yourUSA.ai website and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the Service.

Important Notice: yourUSA.ai is a private company providing document filing services with the help of AI, based on your input. We are not affiliated with USCIS or any U.S. government agency. yourUSA.ai is not a law firm and is not a substitute for an attorney. Use of this site is subject to these Terms of Service.

2. Description of Service

yourUSA.ai provides AI-powered document filing assistance services. Our Service helps users complete various forms, including but not limited to:

  • U.S. Passport application forms (DS-11, DS-82, DS-5504)
  • USCIS immigration forms (I-130, I-130A, I-131, I-485, I-751, I-765, I-864, I-90, N-400)
  • U.S. Nonimmigrant Visa applications (DS-160)

The Service uses artificial intelligence to assist you in filling out forms based on information you provide. We do not provide legal advice, and our Service is not a substitute for professional legal counsel.

3. Eligibility and Account Registration

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

To access certain features of the Service, you may be required to create an account. You can create an account by:

  • Providing your email address and creating a password, or
  • Signing in using a third-party authentication provider (Google, Facebook, or X)

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Use of Service

4.1 Permitted Use

You may use the Service for lawful purposes only and in accordance with these Terms. You agree to:

  • Provide accurate, current, and complete information when using the Service
  • Review all information before submitting any forms
  • Comply with all applicable laws and regulations
  • Maintain the security of your account

4.2 Prohibited Uses

You agree not to use the Service:

  • In any way that violates any applicable federal, state, local, or international law or regulation
  • To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
  • To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
  • In any manner that could disable, overburden, damage, or impair the Service
  • To engage in any automated use of the system, such as using scripts to send comments or messages
  • To interfere with or disrupt the Service or servers or networks connected to the Service
  • To attempt to gain unauthorized access to any portion of the Service or any other accounts, computer systems, or networks
  • To use the Service for any fraudulent or illegal purpose

5. Payment Terms and Token Credits

5.1 Token Credit System

Your account uses a token credit system to manage access to our services:

  • Initial Credit: Upon account creation, you will automatically receive 50,000 token credits to get started.
  • Token Usage: Each message sent or task initiated consumes a small amount of token credits.
  • Insufficient Credits: You cannot initiate new tasks or send messages if your token credit balance is insufficient. You must purchase additional tokens to continue using the Service.
  • Payment for Services: When you pay for a form-filling service, you will receive 50,000 token credits. This provides you with additional credit to continue using the Service.
  • Token Purchase: If you need to continue using the Service after exhausting your credits, you may purchase additional token credits. Payment is $5.00 for 50,000 token credits (minimum purchase: $5.00).
  • Form Regeneration: Users are entitled to free form regeneration for completed forms within 72 hours (3 days) of the original order. The regeneration feature is available for up to 72 hours after your form was completed and does not consume token credits. After 72 hours, the regeneration option is no longer available, and you will need to start a new task if you require additional changes. This policy helps ensure the accuracy and relevance of form updates while maintaining service quality.

5.2 Payment Processing

Certain features of the Service require payment. We use Stripe as our payment processor. By making a payment, you agree to:

  • Provide accurate payment information
  • Authorize us to charge your payment method for the services you purchase
  • Pay all charges incurred by your account

All fees are in U.S. dollars and are non-refundable unless otherwise stated or required by law. We reserve the right to change our pricing at any time, but price changes will not affect purchases already completed.

For refund requests, please contact us at support@yourusa.ai with all necessary details. Refunds will be processed in accordance with our refund policy and applicable law.

6. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by SANK BUSINESS INC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

  • Copy, modify, or create derivative works of the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Remove any copyright or other proprietary notations from the Service
  • Use our trademarks, logos, or other proprietary information without our express written consent

7. User Content and Data

You retain ownership of any information, data, or content you provide to the Service ("User Content"). By providing User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your User Content solely for the purpose of providing and improving the Service.

You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that:

  • You own or have the necessary rights to use and authorize us to use your User Content
  • Your User Content does not violate any third-party rights, including intellectual property, privacy, or publicity rights
  • Your User Content is accurate and not misleading

You can delete your User Content at any time by deleting your account or specific items through the Service. Deletion may take some time to process.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • WARRANTIES THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR QUALITY OF THE SERVICE

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SANK BUSINESS INC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
  • DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE
  • DAMAGES RESULTING FROM ANY CONDUCT OR CONTENT OF THIRD PARTIES ON THE SERVICE
  • UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

10. Indemnification

You agree to defend, indemnify, and hold harmless SANK BUSINESS INC, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees, arising out of or in any way connected with:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party right, including intellectual property, privacy, or publicity rights
  • Your User Content

11. Service Availability

We reserve the right to withdraw or amend the Service, and any service or material we provide, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Service is unavailable at any time or for any period. We may restrict access to some parts of the Service, or the entire Service, to users, including registered users.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by contacting us at support@yourusa.ai or by using the account deletion feature in the Service. Upon termination, we will delete your account and associated data in accordance with our Privacy Policy, except where we are required to retain information for legal purposes.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. We operate exclusively within the United States and are subject only to United States laws and regulations.

Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state and federal courts located in Delaware, United States, and you consent to the personal jurisdiction of such courts.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. The invalid or unenforceable provision will be replaced with a valid, enforceable provision that most closely matches the intent of the original provision.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SANK BUSINESS INC regarding the Service and supersede all prior agreements and understandings, whether written or oral.
